Equine Cremations Canterbury Terms and Conditions of Trade

  • ‍ These are the terms and conditions upon which Equine Cremations Canterbury (ECC) supplies cremation and associated services to you.

  • By signing the consent form and ordering cremation services from ECC, you accept and agree to be bound and abide by these terms.

  • We may amend these terms from time to time. We recommend that you review them each time you engage our services to ensure you understand the terms that apply at that time.

Cremation Services:

  • We provide cremation services. 

  • Cremation is an irreversible and final process. You are responsible for removing any possessions or materials (such as tack, equipment and covers) before collection if you wish to keep them.

  • We will endeavour to complete our cremation services within timescales agreed with you following an initial discussion. However, we reserve the right to change those timescales where reasonably necessary and if this occurs, will aim to do so in consultation with you.

  • We are not responsible for delays outside our control. If we cannot complete the collection and/or cremation service within the times given, we will let you know as soon as possible. If there is a risk of substantial delay you have the right to cancel the contract and receive a refund for any services, you have paid for but not received.

  • We understand that the death of an animal can be very distressing and will take this into account, but we will not accept inappropriate behaviour to our staff and we reserve the right, at our discretion, to decline to supply further services and to terminate our contract with you, if you, or any person, accompanying or connected with you do not respect our staff, whether in person or when speaking to our staff via telephone, e-mail or through our website. 

1. Fees

1.1 GST is charged on all services. Any estimates provided are inclusive of GST.

1.2 Charges are determined according to the services requested by the client, the type of work needing to be undertaken and timelines required.

1.3 Upon completion of our services you will receive a detailed invoice for the transaction.

2. Methods of payment

2.1 A minimum deposit of 50% is required to be paid upon acceptance of our services.  

2.2 Accounts are due for settlement prior to return of your animal’s ashes.

2.3 ECC accepts bank deposit, internet banking and cash payments.

2.4 ECC will supply relevant payment information to the client alongside the invoice.

2.5 Payment terms in variation to 2.1 and 2.2 may be available in some cases but only by prior agreement with ECC and confirmed in writing.

2.6 Interest is payable on any part of the account that is unpaid after the due date for payment until payment is made in full. The default interest rate is 4% above the overdraft rate for ECC trading account calculated on a daily basis.

2.7 Any expenses, disbursements and legal costs incurred by ECC in the enforcement of any rights contained in this contract shall be payable by you including any debt collection agency fees.

3. Estimation of cremation and associated costs

3.1 Unless specifically agreed by ECC in writing, any estimate of costs associated with the cremation and the return of your animal does not amount to a quotation, and the final account may exceed that estimate. You acknowledge that costs may increase due to factors specific to your animal and not able to be ascertained at the time of providing the estimate. If our costs are likely to significantly add to the estimated cost, we will discuss this with you before we start the cremation process.

4. Animal insurance

‍4.1 If you have animal insurance cover for our services, it is your responsibility to settle your ECC account and then claim the fees from your insurance company.

‍4.2 If your insurer requires specific information before agreeing to cover the costs, please let us know so we can finalise that before we start. ‍‍ ‍

5. Complaints, disputes and standards

‍5.1 If you have any concerns about the services we provide, please direct your concerns in the first instance to the Partners at ECC. We will, in good faith, try and resolve these with you. 

5.2 In the event any dispute between the parties is unable to be resolved, the parties shall seek resolution through the use of mediation or other informal methods before any legal action is attempted. 

6. Ownership of records

6.1 Consent forms and similar documents are the property of and shall be retained by ECC.

6.2 Copies will be provided on request, to the client or other third party that the client has consented to receiving these records. 

7. Hours of operation and out-of-hours service

7.1 ECC operates during the standard business hours of 8am to 5pm Monday to Friday.

‍7.2 Due to the nature of the service provided, ECC may be able to carry out collection or cremation services outside of these standard operating hours. There may be increased fees associated with out-of-hours, weekend and public holiday services and you will be informed of any such charges prior to your acceptance of our services.

‍‍8. Variations in terms of trading

8.1 No addition or variation of these terms and conditions will bind ECC unless it is specifically agreed in writing and signed by one of the Partners.

8.2 No agent or person employed by, or under contract with ECC has authority to alter or vary these conditions in any way.

9. Disclosure of Information

9.1 You authorise us to collect and disclose any information about you and your animal for the purpose of instructing other people to assist us to provide the services agreed or to recover outstanding costs, including a debt collection agency and to provide better and personal services to you.

‍‍10. Data Protection and Privacy

10.1 We may obtain, use, process and disclose personal data about you in order that we may discharge our duties under these standard terms of business, and for other related purposes including updating and enhancing client records, analysis for management purposes, statutory returns, crime prevention, legal and regulatory compliance. You have a right to access the personal data we hold about you. We confirm that when processing data on your behalf we will comply with the provisions of the Privacy Act 2000. 

‍‍11. Limitation of Liability

11.1 You agree not to hold ECC liable for, and indemnify them, for any loss to the maximum extent permissible by law. The conditions, warranties and guarantees set out in the Contract and Commercial Law Act 2017 or otherwise implied by statute or common law in so far as the law may allow will not apply and are excluded from these Terms of Trade.

‍‍12. Severance

12.1 If any provision of these Terms is prohibited by law or judged by a court to be unlawful, void or unenforceable, that provision shall, to the extent required, b severed from these Terms as far as possible, and the remaining provisions of these Terms remain unaltered.

‍‍‍‍13. Collection of Ashes

13.1 We will store ashes for a period of 6 months from the date of cremation. If the ashes are not uplifted within that time, whether our account is paid or not, the ashes shall be disposed of.

‍‍14. Owner of Animal

14.1 By instructing us to provide our services you warrant you are the owner of the animal or have the written consent to represent and bind the owner(s) with these terms and conditions. You also warrant no other party has any interest registered or otherwise in the animal.
